The Independent Commission for Overseeing the Implementation of the Constitution celebrated the 17th anniversary of the adoption of the Constitution.
Mohammad Alam Izadyaar First Deputy of the Meshrano Jirga, with congratulating the 17anniversary of the adoption of the Constitution and thanking the Independent Commission for Overseeing the Implementation of the Constitution for holding the Ceremony and said: “The Constitution of the Country in the legal areas is one of the most important and best constitutions in the region.”
Izadyaar added that there are many benefits and values in the constitution, from freedom of expression to privileges for women, the formation of democratic institutions, the freedom of political parties, the separation of the three powers and other issues that are registered in the text of this law they are very important.
The First Deputy of the Meshrano Jirga also referred to the challenges of the constitution and said that violation, escape and refusal to implement the constitution are among the major challenges that are in the process of implementation of this law and other laws.
He also called on governmental and non-governmental officials to spare efforts in implementing the constitution and other laws of the country.
Then, Minister of Justice Fazl Ahmad Manawi spoke about the values of the constitution and the role of the Independent Commission for Overseeing the Implementation of the Constitution in the implementation and realization of the values of this law and said that there are important personalities in this commission that has done national responsibility in its best way.
The Minister of Justice pointed out the gaps in the constitution and said that one third of the appointed members of the Meshrano Jirga have not been introduced yet, which creates many gaps.
He called the provisions of the constitution in accordance with Islamic law and added that all articles of this law are closely compatible with the values of the holy religion of Islam and the custom of the country.
The Minister of Justice emphasized on the supervisory role of the commission and said that, although this commission has been created with delay but good scientific and legal personality has been introduced in this commission and they have been able to fulfill their supervisory duties and competencies in all government and non-governmental organizations.
Then, Qazawatyaar Mohammad Aref Hafez member and secretary of the commission, while presenting a report on the activities of the Independent Commission for Overseeing the Implementation of the Constitution, called this law unique in terms of values in the region and said that this law is the general principles of the government system that has legitimized the Islamic Republic of Afghanistan.
The secretary of the commission spoke about Islamic values in the articles of the constitution and said: "The first article is based on the principle of Islamic state, the second article is based on following the rules of the holy religion of Islam, the third article is based on the beliefs and rules of the holy religion of Islam and the fourth article is national sovereignty through free, direct and secret elections, the provisions of Chapter Two emphasize the guarantee of the fundamental rights and duties of the citizens of the country and most importantly the principle of non-amendment of Articles 1 and 2 concerning the Islamic Republic of Afghanistan, which cannot be changed under any circumstances. . "
He added that defending the principles of the constitution and managing the peace process in the shadow of the constitution is an important and fundamental issue in the country
Qazawatyaar Mohammad Aref Hafez spoke about the importance and necessity of this commission and stated that the Independent Commission for Overseeing the Implementation of the Constitution, in accordance with Article 157 of the Constitution and Article 8 of its special law, is obliged to monitor the implementation of the Constitution in the governmental and non-governmental Organizations. This commission has always monitored the departments to provide the ground for the implementation of the law throughout the country.
He added that the commission has did its monitoring process in accordance with the annual action plan in the light of the National Strategy for Combating Corruption and the Rule of Law through its professional departments has about 105 offices in the second units of the provinces and more than 34 offices in the center including All three powers, as well as 119 non-governmental organizations, including universities, teachers' colleges, schools, hospitals, social institutions, institute and the media.
The secretary of the commission added that the commission issued about twenty legal theories and sent them to its authorities, and presented about 32 proposals for draft laws to the relevant institutions of the Ministry of Justice and has recognized its contradiction and has been presented it to its relevant authorities, and has organized 62 seminars on constitutional awareness in the center and provinces and has distributed about one hundred and 16 thousand three hundred and fifty volumes of the constitution in different departments.
She said that through their publications, they have published constitutional pamphlets, a collection of commentaries, legal advice and opinions, scientific articles, as well as theories of the Constitutional Council of the 60s.
Hafez also pointed out the shortcomings and gaps in the implementation of the constitution by the Institutions and said that the findings of the commission after analysis and review shared with the Institutions to better implement the provisions of the constitution in the form Be justified. He presented the findings to the participants in a documented and scientifically presentation.
At the end, Dr. Seyed Abu Bakr Mottaqi, member of the commission and chairman of the Central Committee for the celebration of the Constitution Week, while summarizing and concluding the speeches said that citizens and officials must abide by the constitution and respect this national guarantee to strengthen the respect for this national document among the people and citizens more than before.
Dr. Mottaqi pointed out the importance of the implementation of the constitution by the media, governmental and non-governmental officials and asked them to respect the constitution of the country and spare efforts to implement this law.
He referred to the values of the holy religion of Islam and said that the Prophet of Islam in the world enacted the first constitution in Medina, which had 48 articles and was called the Medina Order or the Medina Covenant, in which the provisions related to the rights and duties of citizens When there were three groups the emigrants, the Ansar and the Jews, they were introduced to the leadership of the Messenger of Allah.
The chairman of the Central Committee in his last speech referred to the peace process between the government and the Taliban and said that a member of the Independent Commission for Overseeing the Implementation of the Constitution should have been present for discuss and reasonably defended the values and contents of the constitution scientifically and logically.
At the end, the Independent Commission for Overseeing the Implementation of the Constitution presented books, laws, and interpretations of laws published to commemorate the 17th anniversary of the adoption of the Constitution to all participants.
